Bullying

is behaviour that is offensive, intimidating, malicious or insulting, an abuse or misuse of power through means intended to undermine, humiliate, denigrate or injure the recipient.

Burden of proof

now requires that once a person indicates that discrimination, harassment or victimisation has taken place; the complaint will be upheld during a tribunal, unless the employer can prove that the actual or perceived offence did not take place.
